How did you assess girl’s age for marriage when she looks minor: HC to doctor


The High Court on Wednesday directed a doctor to appear in the court to explain how he had certified a girl to be suitable for marriage when it appeared that she was a minor. 
The girl once equipped with the certificate from the doctor that she was old enough got married. The court wants to know how he had determined the age of the girl. A bench of Justice Tashi Rabstan directed Dr Tanveer Hassan Khan to appear in person before the court on October 3 to explain as to how he determined the age of a girl. The couple had approached the court seeking protection of their life and property. 
After observing that the girl who was present before it appeared to be a minor, the court asked the girl how old she was. The girl disclosed that her age certificate was issued by Dr Tanveer Hassan Khan from Ganderbal.
The perusal of the certificate, the court said, does not disclose anything as to how the investigation or examination has been carried out to assess the age of the petitioner (girl). 
Pointing out that the doctor has not attested the specimen signature of the girl as is evident from the certificate, the court said: “Even otherwise the said doctor is not competent to issue Date Of Birth certificate or assess the age of the of the petitioner”. 
“Therefore in the aforesaid circumstances the aforesaid doctor is directed to remain present before the court on next date of hearing for explaining his position,” the court said. The court also asked the parties in the case to remain present in the court on October 3.
